After filing: tracking and maintaining your mark

In short
After filing, the file must be tracked until registration; then the mark must be used, evidence kept and the mark renewed every 10 years. The information below is general: your file's deadlines appear in “My files” and in the office's letters.
File statuses
- To be filed, Filed, Under examination, Published, Opposition, Registered, Partly registered, Refused, Partly refused, Withdrawn.
- These statuses reflect the office's procedure. They never change merely because of payment or time passing.
Office letters and requests
The office may raise an objection (descriptive sign, vague specification) or request a correction. Each letter sets a response deadline: after it, the application may be refused.
Oppositions
The owner of an earlier right may oppose your application within the period set by the office. You can respond, narrow your specification or negotiate a coexistence agreement. You can also watch new applications and oppose them yourself.
Documents to keep
- Filing receipt and publication.
- Registration certificate.
- All office letters and your replies.
- Assignment or licence agreements.
Use and proof of use
In the EU, France, the UK and Switzerland, a mark not used for 5 years for the goods and services listed may be revoked. Keep dated evidence: invoices, catalogues, website screenshots, packaging, adverts.
Watching
No office watches the market for you. Watching new similar applications lets you act within opposition periods.
Renewal
Protection lasts 10 years and can be renewed indefinitely for 10-year periods, within the deadlines set by each office (with a paid grace period).
Changes and extensions
- Change of owner (assignment) or of contact details: to be recorded in the office's register.
- Territorial extension: a new filing, ideally within the 6-month priority period, or via the Madrid System.
FAQ
Should I use the ® symbol?
Only once the mark is registered, and in the countries where it is.
Will I be reminded about renewal?
Yes. YAMARK, as representative for your mark, monitors the expiry date and sends you a reminder within the 6 months before the renewal date, to the email address given when ordering.
Can I change my logo?
Not within the existing registration: a new logo needs a new filing.
